When Does a DUI Become a Felony in Nevada?

Nevada law establishes four conditions under which a DUI charge rises to felony status. Knowing which applies to your situation determines the charge category, sentencing range, and available defense strategies.

  • Third offense within seven years (NRS 484C.400): A third DUI arrest within seven years of the first is charged as a Category B felony. The lookback period runs from arrest date to arrest date, not conviction date. Out-of-state DUI convictions count if the prior offense punishes substantially similar conduct under Nevada law.
  • Any DUI after a prior felony DUI conviction (NRS 484C.410): Once you have a prior felony DUI on your record, every subsequent DUI is charged as a felony regardless of how much time has passed.
  • DUI causing substantial bodily harm (NRS 484C.430): Any DUI, including a first offense, becomes a Category B felony when it causes serious physical injury to another person.
  • DUI causing death with three prior convictions (NRS 484C.440): This is charged as vehicular homicide, a Category A felony carrying the most severe penalties under Nevada law.

Felony DUI Penalties Under Nevada Law

Every felony DUI category in Nevada is a non-probationable offense. Prison is mandatory. The ranges below reflect what the statute requires.

3rd DUI Offense Penalties

A 3rd DUI conviction within 7 years of the first is a Category B felony (NRS 484C.400).

  • Prison term of 1 to 6 years (mandatory; probation not available).
  • $2,000 to $5,000 fine.
  • 3-year driver’s license revocation and 5-day registration suspension.
  • Ignition interlock device required for 1 to 3 years after release (NRS 484C.460).
  • $35 civil penalty fee (NRS 484C.500).
  • Victim Impact Panel and alcohol/drug evaluation.
  • Restricted license not available until at least one full calendar year after release, and only with proof of ignition interlock installation and SR-22 insurance.

Penalties for DUI Causing Injury

DUI causing substantial bodily harm is a Category B felony (NRS 484C.430).

  • Prison term of 2 to 20 years (mandatory; probation not available).
  • Fines from $2,000 to $5,000.

Penalties for a Second Felony DUI

Any DUI after a prior felony DUI conviction is a Category B felony (NRS 484C.410).

  • Prison term of 2 to 15 years.
  • Fines from $2,000 to $5,000.

Death-Causing DUI Penalties

When a defendant faces DUI with death and has 3 previous convictions, the charge becomes a Category A felony of vehicular homicide (NRS 484C.440).

  • 25 years to life in prison.
  • Possibility of parole after 10 years.
