Unlawful Possession for Sale – NRS 453.337 and NRS 453.338 prohibit the possession with intent to sale of controlled substances. Those violating these statutes can be convicted of category B, C, or D felonies depending on the amount and act involved.

Simple Felony Possession of Marijuana – Unlawful possession of Marijuana may be deemed a misdemeanor, gross misdemeanor or category E felony under NRS 453.336.

Penalties for Drug Possession in Nevada

Depending on the category of the drug, the amount and act involved, and the criminal record of the person charged, penalties can vary from probation and /or community service for a first time offense to 1 – 4 years in jail or prison and/or fines of up to $20,000.00. The penalties will drastically be more severe if the offense is drug trafficking.
